A man from Leicester has been prosecuted for environmental offences committed in Harlow and fined a total of over £600 following successful action taken by Harlow Council.

The case was heard on at Chelmsford Magistrates Court in December 2019.

Gary Lamey of Loughborough, Leicester was found to be in breach of Section 87 (1) and (5) of the Environmental Protection Act 1990 following a report of dumped rubbish in May 2019. Officers inspected the area outside Moor Tower and found 13 bags of household waste, cardboard packaging and food waste piled up in the car park area. Evidence was found within the rubbish which revealed an address that was linked to Mr Lamey’s. After further investigation by enforcement Officers a fixed penalty notice was issued.

After failing to pay within the specified period, and despite several reminders, the case was brought to court. Mr Lamey was found guilty in his absence at the hearing and he received a fine of £440. He is also ordered to pay the council’s legal costs of £120 and a victim surcharge of £44.

Councillor Eugenie Harvey, Portfolio Holder for Community and Wellbeing, said:

“I am pleased to see that, once again, our officers have successfully brought someone dumping rubbish and damaging the environment in our town to justice. Choosing to dump rubbish just isn’t acceptable anywhere and, as well as making the area look bad, has the potential to greatly damage the environment. I understand Mr Lamey was in Harlow visiting a friend in the tower block nearby – to dump rubbish in our town and in a residential area whilst paying a visit is beyond belief. Unfortunately it turned out to be a very expensive trip for him!

“We will always take dumped rubbish, fly tipping and littering in Harlow seriously and take action when responding to reports of anyone who dumps rubbish in our town.

“Thank you to both the Community Safety and Legal teams for successfully achieving another prosecution.”
