Basildon Council has issued five fixed penalty notices (FPNs) to waste carriers who have been unable to provide evidence of where they are disposing of their waste.

The fines have been issued by the council’s Street Scene Enforcement and Education Officers since October this year.

It is a legal requirement under section 34 of the Environmental Protection Act (1990) for registered waste carriers to be able to provide these documents to show that waste collected has been deposited at a legal and licensed facility. A failure to provide this information results in a £300 on the spot fine, with a maximum £5,000 fine imposed if the business is subsequently convicted.

The council’s commitment to tackling incidents of flytipping and dumped rubbish was given a boost in September when additional Street Scene Enforcement and Education Officers were hired to work across the borough. The number of officers were increased from three to five in an attempt to educate residents and improve the cleanliness of communities.
